Do I Need A Lawyer?

Over the years, we have often had friends or family members come to us asking, “Do I really need to hire a lawyer?” With the widespread availability of online legal software and the ability to search just about anything on the internet (for better or for worse), people are feeling more and more empowered to tackle legal issues on their own.

A lot of times, this question will rise when couples are negotiating an amicable divorce. While the very concept of a friendly divorce seems strange, there are a growing contingent of individuals who are able to come to an agreement regarding homes and personal property, retirement, and even complicated matters like custody and support without the need for a hearing in front of a judge. When a divorce is an uncontested matter, many people are tempted to draft documents on their own to save on cost. Every circumstance is different, which means each person’s advice will be tailored to their individual circumstances, but here are the top three answers I give when asked about the advisability of not hiring an attorney.

  1. Securing the services of an attorney may not be as expensive as you think. If your situation is truly an uncontested matter, many firms will offer an option for a lower cost or flat-fee rate, giving you the assurance that your documents will be completed correctly and appropriately filed with the court. Because attorneys do these cases so frequently, they are able to make sure that key items are included and your interests are protected.

  2. When children are involved, it is almost always in their best interest to have an attorney assist in structuring the possession schedule and in calculating child support. A qualified legal expert will help guide and structure your parenting plan so that it is acceptable to the court. Additionally, attorneys have the experience to have seen many, many special circumstances and can ensure you don’t commit to an agreement with potential pitfalls.

  3. If the other party hires an attorney, you should consult one as well. As attorneys, we are bound to protect and advocate for our clients. A lawyer hired by your separated spouse will not represent you and your best interests. By retaining your own attorney, you will ensure that you are adequately represented and that all documents will be reviewed and approved by a professional.

From uncontested, agreed matters to complex estate division, our office will be happy to consult with you and form a strategy to accomplish your goals. Call us today for your free consultation - 210.417.4510.
